TERMS & CONDITIONS OF SALE
By approving a quote, paying a deposit, or placing an order with Bluwood Custom Doors, the customer agrees to the following terms and conditions:
1. Custom Product Acknowledgment
All doors are handcrafted custom products built to customer specifications. Because each door is made by hand using natural wood products, variations in grain, color, texture, knots, character marks, and appearance are normal and are not considered defects.
2. Deposits and Payments
A deposit is required before production begins. Deposits are non-refundable once materials have been ordered or production has commenced.
Final payment is due upon delivery, pickup, or installation unless otherwise agreed to in writing.
3. Lead Times
All lead times, delivery dates, and installation dates are estimates only and are not guaranteed. Actual lead times may increase or decrease based on workload, material availability, supplier delays, customer changes, weather, labor availability, shipping conditions, and other factors beyond the control of Bluwood Custom Doors. Any dates provided are for planning purposes only and do not constitute a guarantee of completion.
4. Customer Changes
Any modifications requested after approval may result in additional charges and extended lead times.
5. Inspection Upon Delivery
Customers are responsible for inspecting products upon delivery or pickup. Any concerns regarding workmanship, damage, or order discrepancies must be reported within twenty-four (24) hours of delivery.
6. Handcrafted Construction
Bluwood Custom Doors specializes in handcrafted wood products. Minor variations, joinery characteristics, sanding marks, wood movement, grain differences, natural wood characteristics, and other variations inherent to handcrafted wood products are normal and are not considered defects.
7. Natural Wood Movement
Wood is a natural material and may expand, contract, warp slightly, check, twist, or develop minor movement due to changes in humidity, temperature, and environmental conditions. Such movement is not considered a manufacturing defect.
8. Finishes and Color Variation
Stain colors, paint colors, wood species, and finish appearance may vary from samples, photographs, renderings, or previous projects due to natural wood characteristics and finishing processes. Exact color matches cannot be guaranteed.
9. Customer-Supplied Measurements
Bluwood Custom Doors may rely upon measurements, dimensions, rough opening sizes, specifications, drawings, plans, or information provided by the customer, contractor, builder, architect, designer, or other third parties. Bluwood Custom Doors shall not be responsible for errors, replacement costs, delays, installation issues, modifications, or damages resulting from inaccurate measurements or specifications supplied by others. Any remake or modification required due to incorrect information provided by others shall be treated as a new order and billed accordingly.
10. Installation and Site Conditions
The customer is responsible for ensuring all measurements, openings, framing, rough openings, structural supports, and site conditions are correct before installation. Bluwood Custom Doors is not responsible for costs resulting from inaccurate measurements provided by the customer, contractor, architect, builder, or third party.
11. Warranty
Bluwood Custom Doors warrants workmanship for one (1) year from delivery under normal residential use.
This warranty does not cover:
* Normal wood movement
* Improper installation by others
* Exposure to excessive moisture, humidity, weather, flooding, or direct water intrusion
* Improper finishing or maintenance
* Damage caused by misuse, abuse, accidents, neglect, or modifications after delivery
* Natural changes in wood color, grain, or appearance over time
* Normal wear and tear
12. Limitation of Liability
Bluwood Custom Doors’ liability shall be limited solely to the amount paid for the product at issue. Under no circumstances shall Bluwood Custom Doors be liable for consequential, incidental, indirect, special, punitive, or exemplary damages, including but not limited to project delays, labor costs, contractor expenses, lodging expenses, lost profits, loss of use, financing costs, or replacement costs.
13. Storage Fees
Products not picked up or accepted within fourteen (14) days of completion may be subject to storage fees and handling charges.
14. Final Payment and Punch List Items
Final payment is due upon delivery, pickup, or substantial completion of installation and shall not be withheld due to minor punch-list items, warranty items, adjustments, cosmetic concerns, grain variation, finish variation, or other issues that do not materially impair the intended use of the product. Bluwood Custom Doors agrees to address legitimate warranty or punch-list items within a reasonable timeframe, but such items shall not delay final payment.
15. Right to Cure
Bluwood Custom Doors shall be provided a reasonable opportunity to inspect and correct any alleged defect, workmanship concern, or warranty issue before the customer undertakes repairs, replacement, modifications, or hires a third party to perform corrective work. Failure to provide Bluwood Custom Doors with an opportunity to cure may void any warranty claim.
16. Dispute Resolution
In the event of any dispute arising from the sale, manufacture, delivery, installation, or performance of products provided by Bluwood Custom Doors, the parties agree to first attempt to resolve the matter through good-faith mediation before initiating litigation. Any mediation or legal proceeding shall take place exclusively in Washington County, Arkansas, and shall be governed by the laws of the State of Arkansas.
17. Attorney Fees and Costs
In any action arising from these Terms and Conditions or the sale of products by Bluwood Custom Doors, the prevailing party shall be entitled to recover its reasonable attorney fees, court costs, mediation expenses, and other costs of enforcement as permitted by law.
18. Order Acceptance
Submission of payment, approval of a quote, execution of an agreement, acceptance of delivery, or acceptance of installation constitutes acknowledgment and acceptance of these Terms and Conditions.
